Terms & Conditions of Sale

To all customers:

Please read terms and conditions carefully before Purchasing goods (MCC represents Medway Computer Components Ltd)

    GENERAL

  1. You must be 18years or older and resident in the United Kingdom to purchase from ourselves.
  2. You are responsible for ensuring the suitability and compatibility of all goods before purchase. If you are unsure, please refer to the Manufacturer for advice.Goods are not supplied on a trial basis.
  3. A non refundable deposit may be required under certain circumstances.
  4. We are not obliged to supply the goods to you until we have confirmed acceptance of your order.
  5. Any written quotations given are valid for 48 hours unless otherwise stated.
  6. All goods are subject to availability. We will advise you as soon as possible if we are unable to supply any goods.
  7. Guaranties and Warranties :
    • Any manufactures warranties form a separate contract between the purchaser and the manufacturer and are not of the essence of the contract between the purchaser and MCC.
    • All goods carry a 12month return to base warranty unless stated otherwise.
    • Where goods carry an extended warranty from the manufacturer, it is the sole responsibility of the purchaser to liase directly with the manufacture of the goods for full details of the warranty agreement.
    • The terms of the warranty for goods sold with an ‘On site’ warranty are provided separately and it is the sole responsibility of the purchaser to liase directly with the manufacturer as determined by the warranty. This applies to all monitors and printers.
    • Cases only carry a 48 hour warranty against damage. The power supplies therein are only warranted for 28 days.
    • Cooling fans are not warranted with respect to noise.
    • MCC does not guarantee compatibility of any goods with another unless specifically stated in writing. MCC will however take reasonable care when providing advice on suitability or compatibility of the goods where specific information regarding their use has been provided by the purchaser.
  8. All goods remain the property of MCC until we have been paid in full.
  9. Any sizes and dimensions quoted are approximate.
  10. Payment for the goods will be in cash cleared funds at the time of collection or dispatch unless otherwise agreed by MCC.
  11. Payment may also be made by Credit Card and Switch subject to the following surcharges:
    Switch/Delta Purchases of £20(ex VAT) or under 40p
    Switch/Delta Purchases of £20(ex VAT) or over Nil
    Personal Credit Cards:
    Mastercard/VISA 1.95% on total cost (inc VAT)
    AMEX 2.95% on total cost (inc VAT)
    JCB 2.4% on total cost (inc VAT)
    Maestro International 1.95% on total cost (inc VAT)
    Company Credit Cards:
    Mastercard/VISA 2.4% on total cost (inc VAT)
  12. Payment may be made by cheque in our shop. No surcharge applies to personal cheques supported and within the limit of your cheque guarantee card. All Company cheques and personal cheques in excess of your guarantee card will be Transaxed and subject to a 1.95% surcharge.
  13. Before leaving the shop premises it is the customers responsibility to check that the goods and change received are correct. MCC accepts no responsibility for missing or incorrect items.
  14. MCC will arrange, at the buyers request, carriage of the ordered goods by a carrier to be determined by MCC. MCC are not liable for any negligence, errors or omissions resulting from such arrangement.
  15. All times and dates given for delivery are given in good faith but without obligation.
  16. Carriage charges for the United Kingdom are £7.95 plus VAT for the first 10Kgs. For each additional Kg. the charge is £0.50 plus VAT.
  17. If a customer fails to collect their ordered goods (but not paid for in full) within an agreed time, MCC may at its discretion re-stock the said items and charge a fee for doing so.
  18. Some items of hardware may be OEM. They may not be supplied with drivers/software nor any cables. This is reflected in the item’s price.
  19. MCC will not be liable to you for any consequential or incidental loss, loss of profits (whether direct or indirect), revenue, goodwill, loss of data or any other economic loss arising from use, inability to use, non-compatibility or defect in any item. Any other liability will be limited to the price paid for the goods.
  20. MCC reserves the right to refuse to serve any customer without explanation or notice.
  21. All prices and specifications are subject to change without prior notice.
  22. MCC are not obliged to accept the return of any unwanted or incompatible goods unless covered by the Distance Selling Regulations detailed below.
  23. MCC may, at its discretion, accept goods that have not been opened or used subject to a deduction of a re-stocking fee of 20%.
  24. Any concession allowed shall not affect the strict rights of MCC.
  25. Any boxes received in a damaged condition must be signed for as “damaged” on carriers note, then to notify us immediatley.
  26. Products purchased from us must not be exported in contravention of United States of America export controls.
  27. MCC excludes the application of the Contracts (Rights of Third Parties) Act 1999 to each and every contract under these terms.

    RETURNS

  28. It may be necessary to return the product purchased to us in some limited circumstances. Before returning any goods, please contact us by e-mail or telephone for a Returns Authorisation Number(RAM).
  29. If returning the goods in person to our shop, a Returns Form must completed prior to leaving the goods suspected of being faulty.
  30. You, the Customer, are solely responsible for inspecting the product upon delivery. Any damaged, defective, missing goods or other discrepancies must be reported to us within 48 hours of your delivery.
  31. All products sold are classed as individual items and must be returned as the same if a fault is found.
  32. Any item returned must be returned in the original packaging and include all instruction booklets, manuals, cables, disks, software and proof of purchase.
  33. Any goods found to faulty within 15 days of purchase may be replaced at MCC’s discretion.
  34. For items that become faulty after 15 days of purchase, MCC reserves the right to have the same repaired or replaced. MCC also reserves the right to replace faulty goods with a product of similar or better specification and age. The warranty for the replacement item continues for the duration of the original warranty, i.e. from the original date of purchase.
  35. Every item returned as faulty but found not to be so will incur a charge of £10 plus VAT or 20% of the purchase price plus VAT (whichever is the higher).
  36. A period of up to 21 days may be required to test and replace faulty goods.
  37. Goods purchased and collected from our shop must be returned to our shop.
  38. Return of goods purchased and delivered via our web shop should be carefully packaged and insured for the value of the product. We will not be liable for any items lost or damaged in transit.
  39. Goods supplied to you must only be used for their intended purpose and not be subjected to abuse or unreasonable usage.
  40. The warranty on any goods that on examination show any sign of abuse or unreasonable usage will be void.

    DISTANCE SELLING REGULATIONS

  41. These regulations only apply to products ordered and delivered via our Web Shop. They do not apply to business customers.
  42. You have the right to cancel your order for any item purchased on our Web Site within seven working days following the day of delivery. This right does not apply to software where the seal has been broken nor to media.
  43. To exercise your right of cancellation under these regulations, your order must be cancelled either in writing, by fax or by e-mail. Telephone cancellations cannot be accepted.
  44. Any goods returned must be in an unused and re-saleable condition.
  45. You are responsible for the cost of safe carriage back to us.
  46. The goods should be returned to us within seven working days from the date of cancellation.

    CREDIT ACCOUNTS

  47. Payment is due not more than thirty days after the invoice date.
  48. MCC reserves the right to charge interest for late payment calculated daily at 4% above NatWest base rate both before and after judgement.

    THESE TERMS AND CONDITIONS ARE SUBJECT TO ENGLISH LAW AND THE JURISDICTION OF THE ENGLISH COURTS.
